Welcome to FotoPicks.
These Terms and Conditions ("Terms") govern the use of the FotoPicks website, mobile applications, and the photo and video sharing services provided by FotoPicks (the "Service").
By using FotoPicks or joining an event through FotoPicks, you accept these Terms. If you do not accept these Terms, you must not use the Service.
1. Definitions
In these Terms:
- FotoPicks: the platform that provides the photo and video sharing service
- User: the natural or legal person using FotoPicks Services
- Event: the organization created on FotoPicks in which photo or video content is shared
- Event Owner: the person or organization that creates or manages an event on FotoPicks
- Content: photos, videos, text and other digital material uploaded to or shared through FotoPicks
2. Scope of the Service
FotoPicks is a platform that enables the digital collection, organization and sharing of photos and videos taken at events with authorized people.
The features offered by FotoPicks may be changed, improved, or expanded with new features over time.
Some features may only be available for certain events, plans, or user types.
3. User Account
You may need to create a user account to benefit from some features of the Service.
The user agrees that:
- The information they provide is accurate and up to date
- They will protect the security of their account information
- They are responsible for transactions carried out through their account
- They will not make their account available to others without authorization
FotoPicks may restrict or suspend an account if it determines that false, incomplete, or misleading information has been used.
4. Participating in Events
A link, QR code, event code, or other access method provided by the event owner may be used to join an event.
A person accessing an event must comply with the access rules set by the event owner.
Sharing access information created by the event owner without authorization, or bypassing access restrictions, is prohibited.
5. Uploading Content
A user who uploads content to FotoPicks confirms that they hold the necessary rights to the content they upload, or that they have the necessary permissions to upload and share it.
Users may not upload content that infringes the copyrights, trademark rights, personal rights, right to privacy, or other legal rights of third parties.
6. Prohibited Content
FotoPicks does not allow the upload or sharing of the following content:
- Content that violates the law
- Content that promotes violence or criminal activity
- Content that involves or promotes the sexual exploitation of children
- Content that violates a person's right to privacy
- Content intended for harassment, threats, or bullying
- Content that shares other people's personal information without permission
- Content that infringes copyright or other intellectual property rights
- Content intended for fraud or other unlawful activity
- Content that could endanger the safety of FotoPicks, its users, or third parties
7. Photo and Video Rights
Ownership of photos and videos uploaded to FotoPicks remains with the person who uploaded the content or the relevant rights holder, unless explicitly stated otherwise.
FotoPicks does not claim ownership of content uploaded by users.
To the extent necessary to provide the Service, the user grants FotoPicks a limited license — limited to providing the Service — to host, store, technically process, display, and share the uploaded content within the scope of the relevant event.
8. Photos of Third Parties
If photos or videos include third parties, the person who uploads the content is responsible for ensuring the necessary permission and legal basis exist for uploading and sharing that content.
Particularly for content featuring children, obtaining the necessary parental or legal guardian permission is the responsibility of the relevant user or event owner.
9. Protection of Personal Data
Details on how personal data is processed by FotoPicks are explained in the Privacy Policy and related disclosure texts.
FotoPicks aims to process and protect personal data in accordance with applicable data protection legislation.
10. Event Owner Responsibilities
The event owner is responsible for:
- Ensuring that content shared as part of the event is lawful
- Obtaining the necessary permissions and authorizations
- Providing participants with the necessary information
- Managing event access information appropriately
- Enforcing the event rules they have set
FotoPicks is not a party to the organizational relationship between the event owner and participants.
11. Paid Services
Some features of FotoPicks may be paid. If a paid service is purchased, the user is shown the price, scope, and any other terms of the relevant service at the time of purchase.
12. Cancellation and Refunds
Cancellation and refund terms for paid services are determined based on the nature of the service purchased and applicable legislation.
Refund requests can be submitted through FotoPicks support channels, together with the relevant purchase information.
13. Intellectual Property Rights
Unless otherwise stated, intellectual property rights over the FotoPicks platform's software, design, logo, brand elements, text, graphic elements, and other platform components belong to FotoPicks or the relevant rights holders.
14. Restrictions on Use of the Service
The user may not:
- Use the Service for unlawful purposes
- Attempt to access other users' accounts or events without authorization
- Attempt to bypass or disable security mechanisms
- Use automated systems or methods that could disrupt the normal operation of the Service
- Attempt actions that could damage FotoPicks's infrastructure
- Use FotoPicks to mislead other people
- Attempt to access or download content they are not authorized to access
15. Availability of the Service
FotoPicks strives to provide the Service as uninterrupted and reliable as possible.
However, temporary interruptions to the Service may occur due to maintenance, updates, technical failures, internet infrastructure, third-party services, or other reasons reasonably beyond FotoPicks's control.
16. Removal of Content
FotoPicks has the right to review, remove, or restrict access to content it believes violates these Terms or applicable legislation.
17. Termination of Account or Service
If a user violates these Terms, FotoPicks may temporarily restrict or terminate the account or access to the Service.
18. Third-Party Services
FotoPicks may rely on payment systems, cloud infrastructure, analytics services, or other third-party service providers for the Service to function.
19. Limitation of Liability
To the extent permitted by applicable law, FotoPicks limits its liability for direct or indirect damages that may arise from the use of the Service.
20. Changes
FotoPicks may update these Terms due to the development of the Service or changes in legal and technical requirements.
Updated Terms take effect from the date they are published on the website.
21. Governing Law
The applicable legislation of the Republic of Türkiye governs the application of these Terms.
